Terms & Conditions:

By placing a booking with us, Cumbrian Dreams Ltd whether it is on our behalf or on behalf of the property owners we represent, hereafter referred to as the “Hosts”, you the “Lead Guest” and your booking party the “Joining Guests” agree to the following terms and conditions as set-out within. For ease, when referring to both the Lead Guest and Joining Guests combined, they will be referred to as “Guests”.

Where the person making the booking is different from the Lead Guest taking up occupation of the Property, the person making the booking will be jointly and severally responsible together with the Lead Guest wherever applicable in the Terms & Conditions herewith.

The Guest’s booking will be for the property and land described in the booking listing, hereafter referred to as the “Property” and not for any other areas on the estate.

During the Lead Guest’s and Joining Guest’s (s) stay you agree to abide by the subsequent conditions as set out within.

If the Guests have any questions about booking with the Hosts, please contact the Hosts before making a booking and we will endeavor to assist you.

Coronavirus Guidance & Restrictions:

The Host is committed to adhering to all and any Coronavirus guidance and restrictions, in accordance with the current national and local Government guidance. The Guests can read more about current advice and guidance for accommodation providers on the Gov. UK website.

The Guests can also read the latest on Coronavirus from the Government website.

  1. Whilst the government advice and guidance regarding Coronavirus is applicable, the Guests agree to fully comply with its advice and guidance.
  2. The Lead Guest is responsible to ensure that all Guests adhere to the government advice and guidance before making and throughout the duration of any bookings with the Hosts.
  3. The Lead Guest agrees to indemnify the Hosts for, but not limited to, fines and fixed penalties that may result from any misconduct or breaches committed by the Guests.
  4. The Hosts do not monitor or police what the Guests do and trust that the Guests will fully comply with the government advice and guidance, as per the Guests’ undertaking when making a booking with the Hosts.
  5. The Lead Guest and Joining Guests agree to these terms set out in this Coronavirus Guidance & Restrictions section.

Permitted Group Bookings:

When making a booking for this listing, the Guests confirm that the party group structure is legally categorized as forming a single household or family group or a pre-formed group (which shares characteristics with a single household group). The definition of a single household is in accordance with Housing Act 2004 legislation & Class C3 in Schedule 1 to the Town and Country Planning (Use Classes) Order 1987. Please refer to the link below to determine the exact nature of a single household group – any exception to which the group would NOT serve to constitute a single household and thus would be barred from making a booking for this listing.

For ease of reference, a short summary is contained below:

A single household is characterized by all members of the group being related to one another, in the form of a ‘prescribed relationship’ e.g. those persons are married to each other or live together as husband and wife (or in an equivalent relationship in the case of persons of the same sex), parent, grandparent, child, grandchild, brother, sister, uncle, aunt, nephew, niece or cousin. However, for the purpose of forming a single household, it is sufficient for each member of the group to be related to only one other member of the group.

Booking Process, Holding Deposit & Booking Deposits:

To place a booking with the Hosts the Lead Guest must be at least 25 years of age.

The maximum number of staying guests per room is illustrated in the room occupancy details on the website listing.

Where the person making the booking is different to the Lead Guest taking up the occupation of the Property, the person making the booking and the Lead Guest will be held jointly and severally responsible for any cancellations, non-arrivals and damages as set-out hereafter.

Only the Lead Guest and the named booking party are allowed to use the Property and its facilities, any third-party visitors are only allowed access upon express permission from the Hosts.

To secure any booking, the Hosts require a “Holding Deposit” to be paid in advance, this Holding Deposit amount is equal to 25% of the total reservation cost and 100% of the total reservation cost for bookings booked within ten weeks of the arrival date.

To complete the booking, the Refundable Security Deposit together with the remaining 75% of the reservation cost must be paid at least ten weeks prior to the arrival date.

Where the arrival date is within ten weeks, the total price of the reservation will be due.

Deposit payments must be ‘cleared funds’ before a booking can be confirmed. Deposits are only refundable under the conditions set-out hereafter.

Payments can be made online or over the phone using debit/credit card or via bank transfer (contact the hosts for further details).

Refundable Security Deposit:

To complete the booking, the guest must transfer cleared funds for a Refundable Security Deposit together with the remaining 75% of the reservation cost must be paid at least ten weeks prior to the arrival date.

The Refundable Security Deposit is required as good housekeeping deposit bond (see individual property details for the Refundable Security Deposit amount – the amounts vary for each property), which is added to the cost of your holiday.

This will be returned to you if your accommodation is left in satisfactory condition, within 14 days of your departure. In the event that your accommodation is left in a less than satisfactory condition your good housekeeping/Refundable Security Deposit will not be returned.

Respect:

All Guests agree to respect the privacy and peace of all other staying guests on the estate, neighbors and the Hosts at all times. The Hosts reserves the right to cancel a booking with immediate effect if the Guests are not honoring this agreement or causing a disturbance / nuisance to other guests on the estate, neighbors or the Hosts.

All Guests agree to avoid engaging in any outdoor activities, of the nature which are liable to cause noise disturbance or a raised noised level, past 9.30pm.

If, due to a breach of this agreement, the Hosts cancel the booking, all the Guests agree to peacefully leave the Property and remove all the Guests possessions with immediate effect. In the event the Hosts cancel the booking due breaches of the agreement, the Hosts will not be liable for any charges incurred by the Guests whether this be alternative accommodation or travel arrangements but not limited, nor will the Host be obliged to provide a refund to the Guests.

Check-in & Check-out:

Guests must check-in and check-out by the times stated below;

Check-in from: 4pm and before 10pm on day of arrival (unless a different time has been agreed prior, with the Hosts)

Check-out by: 10am on day of departure (unless a different time has been agreed prior, with the Hosts)

The Hosts can sometimes offer an early check-in or delayed departure, if required. This will be subject to a fee that will be worked out per (early / delayed) hour as this will often mean the Hosts will be required to alter cleaning staff requirements and rely on additional resources, if possible. Any early check-in or delayed departure must be agreed with the Hosts prior to the relevant check-in or departure time.

Cancellation, Returned Deposit & Non-Arrival Conditions:

Guests who need to cancel a booking should contact the Hosts as soon as possible. Deposits already paid are only returned in accordance with the following conditions;

  1. Cancellation made 10 weeks or more in advance of arrival date: the 25% Holding Deposit will not be returned back to the Guest; however, any additional Deposit payments made after the 25% Holding Deposit, will be returned back to the Guest.
  2. Cancellation made between weeks 6 and 10 before the arrival date: 100% of the Refundable Security Deposit and 50% of total deposits made will be returned back to the Guest so long as the Guest has kept up to date with their deposits in accordance with the Booking Process, Holding Deposit & Booking Deposits clause above.
  3. Cancellation made 6 weeks or less of arrival date: 100% of the Refundable Security Deposit will be returned to the Guest. Any other Deposits will not be returned back to the Guest unless the Host is successful with securing another booking for those dates at the same booking price or more, in which case 50% of total deposits made will be returned back to the Guest. This is only so long as the Guest has kept up to date with their deposits in accordance with the Booking Process, Holding Deposit & Booking Deposits clause above.

It’s advisable that Guests take out any appropriate holiday/cancellation insurance where necessary.

In the rare occurrence where the Hosts need to cancel the booking with the Guests, the Hosts will not be held liable for circumstances that are beyond the Hosts’ control and the Hosts’ liability to the Guests is limited to the refund of any payment already made by the Guests.

If the Hosts are forced to cancel the booking with the Guests due to breaches of terms of by said Guests, the Guests will not be eligible for a refund or compensation from the Hosts.

WiFi Fair & Appropriate Usage Policy:

Guests accept to use the Wifi Internet access fairly and appropriately. The Hosts may monitor network performance and user usage in order to maintain a fair and high level of service to all our guests.

The Internet access provided by the Hosts is intended for general use such as access to the world wide web, email, messaging, social media, light video/music/media streaming. It is not intended or ideally suited for heavy media streaming, online gaming, extensive downloads/uploads. Access to illegal activity or the use of the Hosts network for illegal activity is prohibited and will be reported if necessary.

Lost or Stolen Property:

The Hosts shall not be responsible for any of the Guests’ property lost or stolen either from the Property or from any parking, storage, or common area in or about Property and Guests assume all responsibility for the security and safekeeping any such property.

In the event that the Host does recover ‘Lost Property’, the Host will only store these for a maximum of one week, after which, if not claimed, the items will be disposed of and the Guests will not be at right to claim against the Hosts for these losses or resultant losses.

Collection of any ‘Lost Property’ from the Hosts would have to be arranged by the Guests – at their expense. The Hosts may offer to post lost items via recorded delivery on the understanding that the Lead Guest or reimburse the Hosts for the postal costs, alternatively collection from the Hosts can also be arranged.

Damages:

The Hosts reserve the right to charge the Lead Guest for any damages caused through the course of a booking by any of the Guests in the booking party or any person/s that entered the Property with agreement of any of the Guests. This includes but is not limited to breakages, spillages, stains, damage to the Property, furniture or fixtures and fittings. Any accidental damages should be reported as soon as possible in order to minimize damage and associated costs. Lost or unreturned keys will incur a replacement charge per key lost – in some cases where the Hosts feel it necessary to change the locks, the charge incurred by the Hosts in doing this, may be passed on to the Lead Guest.

Smoking & Drug Use:

Smoking of any tobacco products including, but not limited to cigarettes, pipes, e-cigarettes, e-liquids, cigars, snuff or chewing tobacco, is only allowed in designated outdoor areas as sign posted throughout the Property and is in accordance with the Health Act 2006.

The use of illegal drugs are not permitted anywhere in the Property or on the estate. Any evidence of drug use may be reported.

Pets & Service Dogs:

In some of the properties on the estate the Hosts may accept well behaved and trained dogs upon request for an additional small daily fee of £5 per dog, to a maximum of 2 dogs. Please make a request for dogs when making your reservation – the Hosts acceptance of dogs may not always be possible or limited to one.

Parking:

On-site private parking is provided with each Property.

If the Lead Guest requires more than two parking spaces with their booking, they should contact the Hosts to arrange.

The Hosts cannot guarantee that more than two spaces can be provided but will always try to see if more parking spaces can be provided to accommodate the Guests.

All Guests accept that they park their vehicles at their own risk.

Accessibility Statement:

The Hosts have provided an accessibility and access statement, referred to as the information and direction document which they will email and WhatsApp to you prior to your booking.

Your Personal Details & Privacy:

The Hosts are required to keep a register of all guests of ages 16+ who book with the Hosts. This includes full names, addresses and nationality, and/or passport numbers, place of issue, details of next destination (if they are non-British, Irish or Commonwealth guests). This is in accordance with the Immigration (Hotel records) Order 1972. These records are kept for a minimum of 12 months and in accordance with the DPA (Data Protection Act 1998) and the GDPR (General Data Protection Regulation).

The person booking, Lead Guest and Joining Guests confirm that to the best of their knowledge, any personal information or information provided to the Hosts with regards to the booking is accurate and that they have no intention, nor are they aware of any persons from their party who have the intention to mislead the Hosts by providing inaccurate information.

The Host’s policy surrounding the personal details that Guests provide as part of any booking or inquiry through this website / or third-party website, including the privacy of those details, are explained and set out in the Host’s Privacy Notice & Policy.

By making a booking for this listing, Guests accept that any reviews they leave or any entries they make on an online review forum, if available, will not contain personal information or details you would not want to be disclosed. Any entries containing personal details or offensive information that may fall into the DPA and GDPR may be removed and destroyed.

Host’s Right to Cancellation: The Hosts reserve the right to cancel any booking without compensation, refund, or reimbursement if the terms of these conditions are breached.
